I am being sued 1 year after automobile wreck and I had auto insurance?
My question(s) are this: I was at a stop light waiting on the light to turn to a green arrow, I behind this truck and we both went under the light. The next thing I know, my automobile was spinning and I hit the steering wheel. I went to check on the other people to see if they were ok and they were very rude to me claiming I ran the red light when I didn’t, The police came and it ws thier word against mine and I got the ticket.( no witnesses) This was my first wreck and I have been driving since 1987. I sat there and watched these people climb out of there SUV into the ambulance I later looked up thier names on the web and sure enough, these people have sued about 5 people in the past 7 years. Both the man and his wife sued the hospital. The wife later sued a clothing store for Prejudism and lost. Her and her husband both sued for another automobile wreck about 3 years ago and lost it and 2 years ago they sued another insurance company for damages not paid. Now, one year later after the automobile wreck, I got a letter saying they are suing me.( my name was on the lawsuit). They are claiming debilitating injuries and mental discomfort but yet they wait 1 year to the date of the wreck to file suit. I was also injured in the wreck. I ended up with whiplash and my chest hit the sterring wheel but I never tried to sue anyone. I think that is the problem with this country. People are sue crazy and we wonder why things are the way they are now. My question is this: Do I need a lawyer when we go to court? I do not really have the money for a lawyer. I am a mom trying to go back to college and trying to raise a mentally handicap son. I also lost my automobile as a result of this automobile wreck and had to drop out of college for 7 months so I lost things too. I was served last Wednesday and I took the suit papers to my insurance company but I have not heard anything back from them. Everyone is telling me the worse that could happen is a judgement( which will give me bad credit) I am already struggling to get through school and raise my family and now this lawsuit. They cant take much if I dont have anything to give. I have this feeling that these people caused the wreck and are in the business of making wrecks happen but I have no proof because I got the ticket in the wreck and I paid the ticket last year. I guess I am screwed. I just pray that the judge will look at the past suits from these people and see how they like to make money the simple way.
